1. Acceptance of Terms
By downloading, installing, or using OmniDraw (“the Software”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Software.
2. Description of Service
OmniDraw is a local drawing engine that operates via the Model Context Protocol (MCP). It allows AI assistants to create, edit, and export images on your machine. The Software is provided in two tiers: Free and Pro.
3. License Grant
3.1 Free Tier
We grant you a non-exclusive, non-transferable, revocable license to use OmniDraw Free for personal or commercial purposes, subject to the feature limitations of the Free tier.
3.2 Pro Tier
Upon purchasing a Pro license, we grant you a non-exclusive, non-transferable license to use OmniDraw Pro for personal or commercial purposes. The license is tied to a single license key and is valid for the duration of your subscription.
4. Your Content
You retain full ownership of all images, compositions, and creative works you produce using OmniDraw. We claim no rights over your output. You are free to use, sell, distribute, or modify your creations without restriction.
5. Prohibited Use
You agree not to:
- Reverse engineer, decompile, or disassemble the Software
- Redistribute, sublicense, or resell the Software or license keys
- Use the Software for any activity that violates applicable law
- Circumvent or attempt to circumvent license validation mechanisms
- Share your Pro license key with unauthorized third parties
6. Payment and Refunds
Pro subscriptions are billed monthly through our payment provider (Creem). You may cancel your subscription at any time. Refund eligibility is governed by our payment provider's refund policy. Upon cancellation, your Pro features will remain active until the end of the current billing period.
7. Disclaimer of Warranties
OmniDraw is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, OmniDraw and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Software.
9. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of OmniDraw at any time. We will make reasonable efforts to notify users of significant changes.
10. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date. Continued use of the Software after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
